Kidder Law Firm Wins at Ohio Supreme Court

Following its victory in the Seventh District Court of Appeals (opinion available here), Kidder Law Firm recently secured its win for landowners in the Ohio Supreme Court. In a unanimous decision, the Court held that Ohio’s common pleas courts, and not its Public Utilities Commission (PUCO), have jurisdiction to determine whether the use of herbicides to control vegetation is within the scope of a public utility’s easement.
